Terms and Conditions of Sale – NELI

These Terms and Conditions of Sale (the "Terms") set out the conditions under which NELI products are purchased via the website www.nelipresson.com.
Any order implies the customer's unreserved and unrestricted acceptance of these Terms.

2. Products and availability
The gel Press-On Nails offered by NELI are sold subject to availability.
Product descriptions, visuals, photographs, videos and illustrations are provided for information purposes only and are non-contractual. Minor variations may occur owing to the handcrafted nature of certain products.
In the event that a product is out of stock after the order has been validated, NELI shall offer the customer:
a refund,
an exchange, or
a credit note.
NELI reserves the right to modify or withdraw any product from sale without prior notice.
3. Prices and payment
Prices
Prices are displayed in euros (€), inclusive of all taxes.
Delivery charges are indicated before final validation of the order.
NELI reserves the right to modify its prices at any time, it being understood that the applicable price is the one in force at the time the order is validated.

Payments are secured using SSL protocol.
NELI never has access to the customer's banking details at any time.
4. Orders and validation

Any validated order constitutes a firm, final and irrevocable acceptance of these Terms.
NELI reserves the right to refuse or cancel any order in the event of an existing dispute with the customer, suspected fraud or non-payment.
5. Delivery
The terms, timescales and rates for delivery are set out in our Shipping Policy, which forms an integral part of these Terms.
Processing times during peak periods
During peak periods (such as sales, Black Friday, end-of-year holidays, collection launches, pre-orders or promotional operations), certain products may be entirely reproduced by hand on demand.
In such cases, the order processing, manufacturing and preparation time may exceptionally be extended to up to 5 weeks before dispatch.
The customer acknowledges and accepts this additional timeframe upon validation of their order.
NELI undertakes to inform the customer in the event of an exceptionally long lead time and remains available to answer any questions relating to order tracking.
Delivery liability
NELI is not responsible for delays caused by carriers, postal services or events beyond its control (force majeure, strikes, logistical disruptions, weather conditions, etc.).
Transfer of risk takes place upon delivery of the order to the carrier.
6. Returns and refunds
Right of withdrawal
In accordance with applicable legislation, the customer has a period of 14 days from receipt of the order to exercise their right of withdrawal.

Refund
Refunds are issued within 7 days of receipt and verification of the return, via the original means of payment.
Exceptions
For hygiene reasons, products that have been opened, used or worn cannot be returned, save in the event of a proven product defect.

7. Warranty and liability
The products comply with the European standards in force (CE).
NELI cannot be held liable for:
improper use of the products,
incorrect application,
failure to follow the instructions for use,
individual allergies or reactions.
HNZ STUDIO's liability is in any event limited to the amount of the order.
8. Pre-orders and handmade products
Certain products may be offered on a pre-order basis or made to order.
Production lead times are provided for information purposes only and may vary depending on demand and craft-related constraints.
Bespoke or personalised products may not be eligible for the right of withdrawal in accordance with applicable legislation.
9. Force majeure
HNZ STUDIO shall not be held liable for the total or partial non-performance of its obligations in the event of force majeure within the meaning of French law (natural disasters, strikes, pandemics, transport disruptions, governmental decisions, etc.).
10. Intellectual property
All elements of the website (texts, images, visuals, logos, trademarks, design, content) are protected by intellectual property law and remain the exclusive property of HNZ STUDIO, trading under the NELI brand.
Any reproduction, in whole or in part, is strictly prohibited without prior written authorisation.
11. Personal data
Personal data collected is processed by HNZ STUDIO as data controller, in accordance with applicable regulations and with the Privacy Policy available on the website.
12. Governing law and disputes
These Terms are governed by French law.
In the event of a dispute, an amicable resolution shall be sought as a matter of priority.
Failing an amicable agreement, the dispute shall be brought before the Tribunal de commerce de Paris (Paris Commercial Court), subject to any mandatory provisions of public policy applicable to relations with consumers.
In accordance with Article L.612-1 of the French Consumer Code, the customer may also have free recourse to a consumer mediator with a view to the amicable resolution of the dispute.
